As for blacksn0w, I can't see why you could not load blacksn0w - after you had jailbroken a clean iPhone with spirit. However you may experience problems with the hacktivation.. You may need to apply the hacktivation after the jailbreak.
This is all speculation.. but it could be tested
so before I go with 3.1.3 (current 3.1.2) and apply Spirit I need backup with iTunes and shsh Cydia (all done) but first have to wait if it works at all,
Spirit and some (new) unlock tool.
Like most ppl with new 3GS I want go away from tethered Jailbreak.

Here are facts
Spirit works also with 3.1.2
If you rely on unlock - DO NOT update to 3.1.3
Spirit requires the phone to not be stuck at the "connect to itunes screen to activate" this is a different screen to "connect to iTunes to restore" screen which you see during tethered jailbreak.
I have Iphone 3GS, 3.1.2, modem 05.11.07, currently on Blackra1n!
Would following be workable jb+unlock solution to get rid of tethered jb?
1. restoring to 3.1.2
2. activating with vaild SIM card
3. Spirit jailbreaking
4. unlocking with Blacksn0w from Cydia
Would that work?

so, basically I need a activated iPhone (in my case 3GS 3.1.2) in order to Jailbreak with Spirit. My is hacktivated. Original for Orange AT and I'm on E-Plus in DE. For now look bad for me.
