i have a 3.1.2 iphone tethered JB / unlock with blackra1n. i have 3.1.3 SHSH saved with Cydia. is there a way i can upgrade to 3.1.3 or even 4.0 OS ? my phone is week 41 so i think i have the new bootrom

If your blackra1n JB is tethered then you have the new bootrom, regardless of the week. You have three options: non-jailbroken 4.0; tethered 4.0 or untethered 3.1.3 (Spirit).
Once you upgrade to 3.1.3 you won't have tethered 4.0 option any more, though you'll always be able to go back to 3.1.3+Spirit.
It is theoretically possible to back up 3.1.2 iBoot and LLB hashes directly from the NOR, but there are no tools for that, so when you upgrade to 3.1.3 you'll lose the 3.1.2 option and with it - the ability to load pwned kernels and ramdisks.
Also tethered 4.0 option is not very user-friendly and not recommended to anyone who better things to do ;) Basically, you need to do a 'no LLB' restore to 4.0 which will write the root filesystem but not NOR and then use an iBoot exploit to disable signature checks, then load pwned iBEC, DeviceTree and kernelcache from iOS 4.0.
