We know very little about what the new unlock will support. My educated guess is that it will be released for the baseband that will be released with OS 4.0 - so you may need to upgrade to OS 4.0 to be able to unlock. It might work on both OS 4.0 and OS 3.1.3 but I doubt it.

Right now, the advice is to avoid upgrading or changing the iPhone OS and baseband at all. That gives you the most options once the "future unlock" is released.
