can i use dfu mode to upgrade to 4.0.1 then jailbreak it with jailbreakme.com?

You can, but only if you have the SHSH for 4.0.1 -- Apple has stopped signing it now and without the SHSH you cannot upgrade to it.

You can still get 4.0.1 SHSH - I just queried Apple for a 4.0.1 SHSH for my 3GS and got it.
