I think I am correct that a previous user's passcode lock is removed by going into recovery mode.

The problem is getting into recovery mode. I found that even if you get the 'connect to itunes' icon, the Touch may not actually be in recovery mode.

    1. Boot, holding top and home keys.
    2. Let go of top button when Apple logo appears.
    3. Hold down Home button.
    4. Hold down Home button for not 10, but 20-25 seconds. Your thumb will hurt.
    5. Repeat if recovery mode not achieved.

It took me 3 hours to get it right, but eventually iTunes recognised recovery mode.

Keep at it. It is difficult.

Well, im getting some progress!, called apple and theyve now officially registered it in my name (even though I bought it preowned which was suprising!) and booked me an appointment at my neares apple store (60 miles away!) tomorrow. Apparently if they cant fix it they'll help me get a replacement ipod touch ooh-wee!

have you tried powering it off, then just press and hold the home button and plug the cable in. This is this best method i find for getting it into DFU

you keep saying you tried recovery mode, but did you actually timed your hold times and wait patiently enough?

= open windows'c clock or get a watch that shows seconds on it
= connect the ipod to computer with usb cable
= hold the top button, and home key exactly 10 seconds
= release top button, but keep on holding home button another 10 seconds
= release the home button as well, and wait patiently! about 30secs-1min
= it should automaticly go to recovery mode, and you should be able to do restore it...

however you are talking about password? are you able to use the itouch at all? if so, go to settings/general/reset/erase all contents and settings... this should remove everything and you should be able connect to itunes and resync with anytg you want... unless you are not able to use the itouch at all (pass protected) than it sounds abit suspicous, because why would a shop sell the device with password on it? you sure you didnt buy it off the street from someone you dont know?
