No, it's available only if you pay 99USD and if you are an US Company

i think i will need the xcode 3 for leopard other than the SDK.

Looks like too many people want it! The whole iPhone dev site is down. If you switch to https then you can access the site but because of the way the dev center handles logins, you can't download the SDK... Looks like my MacBook will have to wait!

I think I'm going to install vmware leopard on vmware

It does, but the site is overloaded. That will skip you through clicking through a bunch of other pages that are hit or miss right now.
