So I found an iPhone 4 on Telus 4.2.1 and there was no contact information to return it so I've kept it.
I'm on Bell so I'm looking to upgrade to iOS 5 and unlock to work. I'm okay with even 4.3.3 or the latest so I can use it on my network, I've looked all over the internet but there isn't anything that helps, so I'm asking here what my best option would be. Modem FW is 03.10.01
Unfortunately we cannot assist -- if you find a device that has been lost and obviously isn't yours, you need to turn it in to law enforcement. If they return the device to you after 30 or 60 days without finding the owner, they can then assist you in getting the paperwork needed to have the carrier activate the device. That's pretty much the long and short of what we can assist you with. When it comes down to it, found or not, it's not your phone -- shame on whoever lost it, but that's no excuse to keep an item you didn't purchase.
Only once the device has been returned to you as 'no owner found', could we assist. Thankfully you're in Canada, and they do not employ an IMEI blacklist -- if they did, it would be even more difficult to get the phone to work again.
Please return the phone to law enforcement and if they return to you in 30/60, then worry about unlocking it. As it stands, regardless of whether or not it's in your hands, it's really not your phone... If you left your phone somewhere, you'd definitely kick yourself for doing it, but you'd also expect that the person who found it would do the right thing. Be the person doing the right thing for someone else's lost device and turn it in.
