    I don't think Gizmodo has done anything illegal. They had no way of knowing when they purchased the device that it was a true, legitimate prototype (or model) for the next iPhone. When they received confirmation from Apple (via the letter from Apple's legal counsel requesting the device be returned), they immediately complied.

    While I'm sure Steve is upset that his secret leaked early, this really isn't anything astronomical. The only surprise to most people was the stylistic changes.

    Front facing camera? Please. That's been rumored for the last 2 updates. Higher res screen? See previous statement. Faster processor? That's just the norm for their iterative releases.

    It could be argued that Apple's competition now knows what they're competing against two months early, but frankly, if Apple's competition didn't expect this, they're all morons -- we've been predicting these same changes for 2+ years here...

    I don't think Apple should sue, unless they want to generate some bad publicity, and I don't think they should kibosh Gizmodo's access to future press events -- this is the best coverage Apple has gotten since the iPad...

    "It's all marketing lie" is missing. Hell, why wasn't the board shown? The most interesting part of the iphone was left out, and I take a bet its part of a contract
