So if you have your 3GS replaced in the store right now...

... what happens?

Mine happens to have some sort of network connectivity issue every now and then which is not that disturbing but might serve me as a reason to have it replaced in the store during the 1time warranty time which I would love as mine has some scratches :(.

As I'm already down 8-10months since the purchase I guess I'd get a refurbished one (which would be perfectly fine for me).

But now the interesting question is: Which software would I get?

I got an UK phone in Germany and therefore need an unlock (+jailbreak obviously), so if I get a 3.1.3 I could spirit-jailbreak and blackweather-unlock and would be all set, but if I get anything else I'm pretty much doomed as long as O2 doesnt unlock my phone.

Any ideas here?

It's luck of the draw. Most users are getting 3.1.3 at this point but one of my employees got 3.1.2 on a replacement device about three weeks ago.

I'd hold off until next month when the new hardware is out -- that way you'll likely get 3.1.3 and the unlock for that baseband will have been released.
