Is there anyway to block AT&T from knowing there is a 3gs on their network. I upgraded to 4 and gave my daughter my 3gs. She doesn't need a data plan, but they detected it and charged me $25.

I do not think you can do this in any legal manner. Every GSM phone identifies itself by sending the International Mobile Equipment Identifier (IMEI) telling the carrier the identity of the phone.
alphaalpha is correct. The only way to block this is to falsify the IMEI information, which is thoroughly illegal in the USA.
