This is an Australian 3GS model number. I own same model number and it is officially unlocked and working in Norway fine.
It is possible that yours is still locked to one of the australian telephone carriers. Hard to know which one.
What message do you get when you connect it to iTunes for activation?

Ok, so it looks like i won't be able to unlock it, and optus will not unlock until I have recharged with at least $80 credit which I am willing to do.
What is the best jailbreak method if possible.
Being 3.1.3 out of the box I am pretty sure it has the new bootloader.
I checked Snowbreeze, but it doesnt support the new bootloader, same deal with blacksn0w.
Any idea's?

Hope you did not pay too much for the phone on eBay. An offically unlocked phone can be bought at official applestores in oz for just over $1000 for the 32gb model. Anything cheaper than that is not a bargain but a scam/ripoff.
Pay the $80 for carrier unlock it is worth it. There will not be a unofficial unlock for a few months.
Also. Buying an iPhone in April when Apple is guaranteed to release a new model with better features in June is a bit crazy. If you get it officially unlocked, makes it easier to sell and upgrade to a new iPhone in the future.

The phone was $990AUD but because I paid by paypal, he asked me to cover the fee's and it ended up costing $1030.
Then I just paid $29.95 for an optus starter kit.
I am better off just recharging with another $50 then optus will unlock it.
At least I will get the value of the calls.
I'm pretty bummed though that I won't be able to jailbreak it 
An unjailbroken iPhone is quite boring in my opinion, lol, I can't afford to pay for my apps.

Really you have not been had for too much money - as I said officially unlocked 3GS 32GB I think cost $1040 or $1080 at Apple stores.
I'm originally Australian (haven't lived there for 4 years now) but it really is not too hard to either get to one of the handful of official Apple stores (Sydney has three now and there are two in Melbourne I think) or get a friend to buy one for you from these stores. Other countries don't have the luxury of official unlocked iPhones from a legitimate source (eg USA). Only in the 2G iPhone days would I have advised an aussie to resort to eBay to get an unlocked iPhone.
Also, you should know better (you have been on this forum a while) than to suggest app piracy on this forum. Pay for your apps, it's what keeps the jailbreakers afloat. Many of them sell apps via AppStore and/or Cydia.
Any further mention of app piracy won't be tolerated on this forum. Jailbreaking is not for app piracy - it is for doing things that Apple won't allow via the AppStore.

What you should've done (or should do if it hasn't been 30 days since transaction took place) is to file a claim with Ebay. You would've gotten your money back with short delay. What you were going to lose is the shipping cost to send it back to the seller. Better lose a few bucks for shipping than end up having a locked phone for undetermined period of time.
