Your bootloader does not generally get upgraded by an iPhone OS upgrade. In fact it has only happened in the OS 1.0.x days

The bootrom is hardcoded in the factory and can never be changed.

Yes hackers have proved they have a jailbreak for 3.1.3 on the 3GS and for 3.2 on the iPad - however they will wait until iPhone OS 4.0 is released (June/July) before the jailbreak is made public. This is good strategy.

    1) Your question about 3.1.3 has been asked and answered about 6000 times already. Please use the search button in the future. There is an exploit in 3.1.3 and 3.2 that has been confirmed, but no tools have been released and are not planned for release until the new hardware is released (expected July).

    2) There is no easy way to reliably find out on a non-jailbroken phone. In that case you're forced to guess based on the manufacturing week that can be extrapolated from the S/N. For information on how to determine the bootrom on a jailbroken device, check here: iClarified - iPhone - How to Check Your iPhone Bootloader Version (Windows)
