Call O2 and ask them to verify that the phone is not 'barred' from using the network. This is something they would have done if it had been reported stollen or an insurance claim had been filed to replace it. you never know what the previous owner has done unless you know them and can ask.
If it is barred it will never work in the UK but will work overseas if it had been unlocked. There is no way to unlock on 3.1.3 so you might be stuck with a touch instead of a fully functioning phone.
Let us know how you get on with O2.
PS there are webs sites that will check the IMEI number to validate barring but the charge you for the service I believe.

phone was from a friend so no worries there.
phoned o2 but because i got me sim from carphone warehoue (cpw) and not o2, cpw dont dont have a deignated iphone team!
they told me to fone o2 direct, but because my contract sim is not with them as such, the automated service told me to phone cpw (vicious circle lol)
gonna try o2 directly again, will let u know how i go.
