    Default [iPhone 3G] How to get out of contract without fees

    Just making a clear post about this.
    Before I detail what I did, understand that your mileage may vary, I'm merely sharing what worked for my friend and I.

    1. Buy an iPhone from the Apple store, sign contract, activate

    2. Use it a bit if you want, w/e

    3 1 or 2 days after purchasing and activating contract, call AT&T

    4. Tell them you want to cancel the contract due to bad reception at home and/or at work

    5. They may try to put you to a Tech to troubleshoot, if they insist, agree, if not, go to step 7. If you talk to the tech, tell him you've tried the SIM card in different phones, and all of them have bad reception which makes it very frustrating to use the phone/service.

    6. After discussing the matter, come to the conclusion it must be due to the building material and that it's a real shame. Ask to be put to someone to cancel your account

    7. When talking to person to cancel your account, tell him you'd like to keep the phone in the event you'd like to come back to AT&T at a later date and would rather not have to go through the process of acquiring a new device.

    8. If he says you will pay full price, quote that since you're cancelling within 3 days, no fees are incurred

    9. If he says tyou must return the device, tell him you bought it from the Apple store, not the AT&T store.

    10. Account should get canceled and the iphone is yours for 200$ or 300$, without fees.

    I realize the ToS may not be for the iphone 3G, but the ToS seems to apply for any and all phones, including 3G phones. I take no responsibility if anything goes wrong. Just sharing what happened for my friend and I.

    Specific quote:
    Cancellations/Early Termination Fee: An Early Termination Fee may be assessed against you in the event that you terminate your Wireless Service Agreement and/or selected plan before the expiration of its term. The fee will begin at $175 per device and decrease by $5 each month for the term of the agreement. You may cancel your service, for any reason and without incurring the Early Termination Fee, within thirty (30) days of signing your Wireless Service Agreement, PROVIDED, however, that if you cancel service you will remain responsible for any service fees and charges incurred. If you cancel within three (3) days of signing your Wireless Service Agreement, you will be entitled to a refund of your activation fee, if any. If you exercise this option, you may be required to return devices and associated accessories purchased in connection with your Wireless Service Agreement.
    Again, your mileage may/will vary. It worked for me and my buddy. I was very patient and I actually was planning on paying the fees, but the rep I got told me about the 3 day termination policy.

    Another friend of mine just tried it. Same result, we're all contract free. We've also double checked our IMEIs ( http://www.amta.org.au/default.asp?Page=405 ) and have tried each one with my gf's AT&T SIM, they all work like they used to.

    Holy crap batman it works, i told them i got it from apple store and would want to keep the phones until my signal gets better and all they did was charge me $25 to cancel because of my 5 lines. So i got 5 phones at a cheap price. Thanks LORD.

    DarkLord, did you sign up for your AT&T contract as a brand new customer? Or were you already with them?

    Man, that looks way too easy.... So you say you wanna keep the phone, pointing that you bought it from Apple, not at&t, and they say "ah, ok then"..??

    I just called AT&T and the customer service rep said I had to take it back to the Apple store to cancel. He seemed firm.

    Maybe I'll call later and get another rep?

    I was a new at&t customer, the rep first told me i had to goto apple store to cancel. I then told her apple store does not know how to cancel. So she said she would do it.

    I then told her that can i keep the phone at no extra charge just in case i want to come back to at&t, she said that was ok.

    I made her put notes on my account saying that i wanted to keep the phone and that i will not be charge any extra fees except for the pro rated charge for the pass 3 days, which is about $25.

    I guess it all depends on the rep, just say u might wanna come back.

    That does seem too good to be true. So I decided to do my own research. I called an apple retail store explaining how I bought a 3G from them yesterday. I told them I wasn't happy with the phone reception so I was planning on cancelling the contract. I asked where do I return the phone to...AT&T or to Apple store. The guy said I can return the phone to them with a full refund and no restocking fee. I then asked him if I can just keep the phone just in case I wanted to sign with AT&T again at a later time. He said you can but if you bought it for a subsidize price you will be billed by AT&T for the difference. Meaning if I bought it for $199 they will bill me $400...like buying the phone without contract. But then again, the guy could have been bullshittin' to me. How would AT&T know when or if I returned the phone to Apple?

    Don't thank the Lord yet. I would bet you will later be billed by AT&T as buying the phone without contract. When you do see that on your bill and decided it's best to return the phones, they will charge you a 10 percent restocking fee. Well, I hope I'm wrong. It would be really nice to get a 3G iphone for $199 and use it with another carrier.
