Depends. In your case, it would be most likely Apple would replace the device, so you'd probably get a locked device in return no matter what you do.
If it's just a screen issue (which I know it's not), then they will sometimes just do the screen repair on-site, but most higher-level repairs will be sent off-site for repair and they just provide you a refurb -- which will probably have the latest bootrom and the latest 3.1.3 firmware and 05.12.01 baseband, rendering your phone not unlockable.
You may have better luck looking for an off-the-beaten-path iPhone repair facility where a guy may just replace the microphone -- your chances with Apple having your phone are extremely slim -- you'd want to restore back to factory first, re-locking your phone... Since it's a 3G, you can almost always jailbreak from 3.1.3, but the unlock is going to be tricky...
Not altogether too much you can do to be safe here, I hate to say.

i knew it was wishful thinking on my behalf! I did find one local place today where they will replace the mic (the mic speaker and connector are all 1 part) for £50 so guess il have to stick with this!
