Default [Warranty] how to get a replacement from apple if unlocked?

Hi guys, I purchased my phone back in september 2007, got it unlock as soon as purchased and set it on T-MOBILE, suddenly the phone stop working, if i leave it off and not plug into the charger after 3 days it turns back on, but if i start to do a few things it crashes, one of the times it turned on i managed to reflash it back for factory, i took it to apple store, without the simcard, they told me they could replace the phone but that they needed the old att sim, also he stated that the phone would need to be activated with itunes, is that true? cuz i never did, and he told me that by the serial number he could tell it wasnt.

any sugestions on the matter, what should i tell this guys? I love to get my phone back and working

you dont have to be activated with iTunes. Even apple say that on their site (but they always try to get you on that one anyway) go to this link: https://selfsolve.apple.com/GetWarranty.do and then enter your serial # and country that your iphone is from. It should say something about no needing to be activated (but I think thats only after entering your serial #)

but its reasonable to have your old AT&T SIM, but just tell the guy you dont need to be activated
