    Think of it this way - you own the device. Adding or changing anything on it is your right. As soon as you change it, the company selling it does not have to cover it under warranty. BUT they cannot stop you from adding or removing items that are part of your device.

    The issue to be concerned about is using an unlicensed software program. With your Iphone you buy the software from Apple. But you are not allowed to change their software. This does not mean you can't add or remove software from your phone. You just cannot alter their software. So as long as the unlock does not use Apple software that has been altered there should be nothing illegal about it. If a hacker alters Apples software and uses it, that would be illegal.

    What about turbosim? is the use of turbosim illegal in the U.S.? Could it be sold over Ebay? or is it only legal in Europe?

    This is not -exactly- true.

    For example, technically, mod chips for game consoles are a violation of the DMCA and illegal. That said, the console is very much my property so I would -think- that I have the right to do anything with it or change it. However, because a mod chip is a 'copyright circumvention technology' it's technically not legal to install and use one in a game console, even if you don't play copied games. Why? Because you circumvented the copyright protected technology simply by installing a mod chip. What you do with it after that is academic.

    On the other hand, unlocking an iPhone (or any phone for that matter) is explicitly exempted from this law.

    This makes it totally legal. Even the firmware files (the ipsw) are fair game to hack, rip apart, break encryption on, etc. Yes, it's Apple copyrighted property and if anyone used it to launch their own iPhone competitor, Apple could sue them into oblivion. But we as end users are specifically granted permission to do pretty much anything we like with them.

    Want proof?

    AnySIM requires the secpacks for the firmware revisions it supports unlocking. Without them, you cannot update the baseband. For this reason, AnySIM actually INCLUDES these secpacks in the application bundle.

    If that wasn't legal, do you really think Apple would allow us to brazenly host copies of AnySIM, installable via an easy to use graphical interface (Installer.app). It circumvents their network blocks AND it contains their intellectual property!

    Not the Apple I know... not ever.
