So i think i would like to exchange my iphone at the apple store. I have not unlocked it. I currently have a contract with cingular, but i do not have an iphone plan. What steps to i follow to restore my phone so that i can return it to apple and get new one.

How about putting it into restore mode (aka Home Button + Power Button) and restoring it through iTunes?

Okay. Now my next question since the problem i am having is with the phone not receiving calls while in sleep mode, how do i tell them that that is defective if i dont have an iphone plan. Also, 1.1.3 isn't out yet so I will still be able to use the new phone?

Are you using a TurboSIM-like solution? Because there's no way you can make calls on a locked iPhone. Got confused at that part

No i am using a locked iphone that has been unlocked using ibrikr and jailbreak, and i use it with my cingular service that is not iphone specific.

It's getting more and more confusing. You just said in your first post you haven't unlocked it. Now you're saying you have unlocked it? Maybe you're confusing "unlocking" with "jailbreaking".

yes im sorry for that mistake. I have not unlocked the iphone, but jailbreaked it and activated it using ibrickr, so the phone is virtually unchanged, but is not working properly (loss of signal in sleep mode) and so i would like to exchange it.

I don't think it is defective at all. I think this is a known issue. Search the forum. I almost 100% sure I've seen a lot of people with the same problem.
