Hi,
I bought a Macbook Pro off ebay, and i think the charger is on the way out. I have checked the serial number against applecare's warranty check and it says its valid until June 2010.

The battery Time / Percent is up and down like a yoyo, and the charge is making a sizzling noise
Do you reckon i could call apple and get it replaced, or is the warranty only with the person who 1st bought it?

I think that the warranty is tied to the serial number. Try to call Apple

Do you have Leopard or Snow Leopard? If you have SL, just Option + click on the battery indicator. It will display a menu with the battery status, and will tell you if it need replacement.
Also, I would recommend a clean Snow Leopard install to see if it is a hardware or a software problem

Many thanks for the reply. This is the strange thing. Sometimes it will say Battery : Normal (off charge) , and then sometimes it will say Service Battery (on charge).
My Snow Leopard Install is a Clean Install, not an upgrade,
What do you think i should do?

You should try:
1. Calibrate your battery: Plug the charger until LED gets green. It must be with the green light at least 2 hours (you can use the computer). Unplug the charger with the computer running, and use it until the battery drains and shut downs your computer. It should be with the battery drained at least 5 hours. After that, plug the charger until LED gets green again (full recharged, you can use your computer).
2. If it does not work, reset SMC: See this article Apple Portables: Resetting the System Management Controller (SMC)
3. If it does not work, try resetting PRAM and NVRAM. See this article: Resetting your Mac's PRAM and NVRAM
If nothing works, your battery may need replacement. Contact Apple.

You shouldn't have any problems with warranty work... Just take it into an apple store or call 1-800-APL-CARE
