the iphone is week 41 and has the older box brand new what are the chances that it has 3.9 bootloader on it?

possible but you'll never know it could be a refurbished, to know for sure you need to jailbreak or at least do an emergency call *#307#, mine is from week 41 1.1.1

well did you buy it from Apple? Cuz if you did then it must be refurbished. If not then you wont really know until you find out the firmware.

You can usually tell by the IMEI...

01136400, or 01136500 99.9% probability 4.6

I have a week 42 and is 3.9 bootloader, so if it is a real new, and not refurbished you have 99.9% chance is the good old 3.9

Just jailbreak and check for the bootloader.
