If you buy from a store that does really, really low volume in iPhone sales, then I guess it is theoretically possible for you to get a BL3.9 phone. The BL version is a moot point now anyway, we're free to move between the two versions with bootneuter.
Thatīs the point... the store has newer version, and it is brand new from the factory, maybe a week old.

...and how exactly are you checking the bootloader version? I highly, highly doubt that Apple would start reverting back to 3.9 (if anything, we'd get 4.7), so it is most likely user error.
Yeah, what are the first five (or the fourth anf fifth) digits of the serial number? This will give us the week the iPhone was made which will reveal the bootloader version.

I think he used ziphone to unlock it and ziphone automatically puts 3.9 on your phone
