Erase all content and settings - removes the operating system as well. This is by design.
Was the iPhone jailbroken before (with something else than Spirit) you did the erase all content and settings?
Is the 3GS old bootrom? see PwnageTool 3.1.4 for Mac OS X for details on how to check
Do you have a SHSH for 3.1.3 or lower? The Firmware Umbrella The Firmware Umbrella can help you find that out.
if so you can restore with the saved SHSH and jailbreak again.
Otherwise you are stuck restoring to iOS 4.0.1 (yeap you can't even restore to 4.0 any more - Apple has already blocked that).
