No, but using free WiFi without authorizations isn't exactly a "moral grey area" anymore either. Michigan, for instance, has a law on the books that allows for the prosecution of anyone found logging on to a network without permission. A guy was actually arrested for logging on to a cafe's free hotspot from his car since the network was advertised as "for customers only" and he never set foot in the cafe.
Are you likely to be caught? Probably not, but it is interesting to note that simply logging on to the free, non-protected wireless at your local cafe from the parking lot is illegal enough in some locales to land you in jail. Actively trying to crack an encrypted network is just more universally illegal.

Personally, my take on the whole Wi-Fi issue is this: If the network is open, and broadcasting it's SSID, then it's exactly that: an network open to the public and being advertised as such. As a result, if somebody connects to it, that should be perfectly fine, since it's a public network. People need to learn how to read instructions if they don't want to run their network publicly. Another thing regarding the issue, is the bullshit about the ISP's being the victim of service theft because of this. Honestly, if it's really that much of an issue (which it probably isn't), then the ISP's should be going after the customers publicly sharing their connection (and yes, if they do this, they also get to take the bad publicity that comes with it). They should not be going after people using the Wi-Fi connections, because they're having the connections advertised to them as being OK to use.
Now, if the wireless connection has some sort of protection on it, even if it's something trivial to crack like WEP, then I think at that point you're not advertising an open network, you have made it clear that you don't want people inside, and if somebody connects to it without authorization then they're hacking it and deserve to deal with the consequences.

it would take quite a while to collect enough traffic to crack the encryption key on a pretty quite network. i dont think i want to be sitting there for a few hours when i can just go home and use my own wifi. just pay your dang 15 dollars for edge or whatever.

without airodump you can not collect IV's which are needed for aircrack

How about this, let's compare the internet access to a pretty girl, if you were to, say, tear off her clothes that she has intentionally put on to avoid people being able to see her private areas, That would be wrong. But if she were to be walking around in the nude, whether she wants people to see her or she just doesn't realize she is in plain view, is it illegal to watch her? I think not.
In case you cant figure it out, nude=internet access; clothing = encryption; tearing clothes off = Hacking encryption
