@jodysanders: you're quoting the license terms of libraries we included in our software.

in a case like ours in which the license terms aren't explicitly listed in our distribution, it does not mean our work is automatically in the public domain. the "all rights reserved" you see everywhere is the default, and you should've contacted us (the dev team) with regards to licensing if you intended to not only use and sell our program, but to modify it.

But there is no copyright notice for your software, you do not have a legal leg to stand on.
The 1886 Berne Convention first established recognition of copyrights among sovereign nations, rather than merely bilaterally. Under the Berne Convention, copyrights for creative works do not have to be asserted or declared, as they are automatically in force at creation: an author need not "register" or "apply for" a copyright in countries adhering to the Berne Convention. As soon as a work is "fixed", that is, written or recorded on some physical medium, its author is automatically entitled to all copyrights in the work, and to any derivative works unless and until the author explicitly disclaims them, or until the copyright expires.

We will not be intimated or bullied by yourselves into not distributing this application as we are not infringing on any license. While you may question our morals in doing what we are doing, legally without question we are acting properly.

For goodness sake lets move on from this and try to come to an arrangement, we are providing a service for those people who aren't adept enough technically, would you rather these people rely shackled to AT&T or whoever, or if you are such champions of freedom that you suggest, why is this a problem.

You really need to sort your licensing issues out yourselves, and work out what license the software is released under, because at the moment there is no license and legally you are not protected which isn't good for you.

We can help with all these matters.

No, you are redistributing Apple's firmware and our software, you are also redistributing our software and modifying it without consent (you also do this with Apple's .ipsw).

No, read what we wrote in our blog, we specifically told people the location of the file and NOT to download it.

We have spoken already, remember we have a large community of people here who would gladly contribute funds to pay for a legal case against you, watch this space.

you misunderstand copyright law. the moment we create our work, it is our copyright, and just because we didn't write some legalese on the bottom of our webpage doesn't mean you can go selling it without our consent.

@pumpkin - can I speak to anyone from you guys on the telephone and engage in sensible dialogue? if so please someone send me a PM. All I seem to get on here is various forms of abuse.

@jodysanders: I'm sorry, I don't support the abuse against you, but you must realize that you aren't going to be very popular on here if you're perceived as selling something others can get for free. I realize that you're providing the added service of simplifying the process, but it's not clearly labeled as such on your site, which (last I looked) didn't give the impression there was any other option but to pay up. I have personally put in dozens of hours of my free time, often staying up all night and sacrificing time with friends, to get pwnage working, and I didn't even work on the tool itself (that was wizdaz and his hundreds of hours of free time) and to see people making money off of something which we willingly gave up so much time for is frustrating.

As a shouldacouldawoulda, you should've contacted us, the copyright holders, before infringing on our work by both selling it and modifying it (and not giving credit, other than leaving our existing credits in place.) We might have come to an agreement that way. But as it stands, you've just alienated and annoyed several of our members by arrogantly citing misunderstandings of copyright law as a justification for your actions. I personally doubt this will ever make it to court, but the decent thing for you to do now would be to start anew, take down what you have up for now, and ask us nicely what we can do about this situation, in some form of private communication. I don't really want to get involved in this more than I have to, but I'm sure you'll be able to find another dev team member to talk to.
