The subject of this claim is what is hot - what makes Apple hardware Apple hardware? Name a part of an apple computer that is "made by apple". You can't. It's all third party. Intel makes the processors. Broadcom or Atheros makes the wireless cards. Asus and Quanta make the cases. Realtek makes the sound. Matsushita/aka Panasonic makes the dvd drive. Hitachi makes the hard drive. Marvell makes the lan card. They run off of ICH7 mobos, so usb is intel and firewire is agere. Bleh, you get the point. If that is all Apple hardware, then what makes Apple hardware Apple hardware? an EULA is an EULA, worth nothing in court, and the reason why Apple hasn't sued Psystar? because other than a TPM chip, there's not much difference at all. It all comes down to the Apple logo being placed on 3rd party hardware that's also used to make other brand name PCs, and that's why they would fail in a law suit.
If I'm incorrect about anything legal wise here let me know, I'm just saying what I've learned so far by studying the legal aspects of this situation. Boogahoo!
