    Is this a brand new 8GB iPod Touch or have you upgraded to 3.1.2?

    Blackra1n should work. Let iTunes activate the iPod touch first.

    Your other option is to downgrade to 3.0, jailbreak with redsn0w and then restore using a custom ipsw made with PwnageTool. I don't see much advantage with this approach.
